CalPERS Issues Clarification and Guidance on AB 1028

A new law that went into effect January 1, 2012, made minor changes to the codes governing the hiring of retired annuitants by CalPERS employers. AB 1028 clarified the rules for State, California State University, school and public agencies to ensure proper classifications are used when employing annuitants. Most public agency and other annuitants are hired under Government Codes 21224 and 21229. The updated provisions state that annuitants must possess specialized skills, but may work for more than one fiscal year to provide extra help as long as they fill temporary positions and do not exceed 960 hours worked per fiscal year. Clarifying changes were also made to section 21221, which applies only to public agency employers. It allows for a maximum of 12 months of employment in an interim position. Please break this law down to me in layman's terms. I worked and retired from Placer County. I have worked EH since then in different departments. It is my understanding that I can still work there EH and receive similiar pay to what the position pay is or is this a Placer County agreement not pertaining to Calpers and other agencies? Is that correct. I am in a clerical position. I know I can only work 960 hours per year, but is that clarification stating that I can only work 1 year and then I am done. I would appreciate a correct breakdown of this. Thank you. Donna Goering
