CalPERS Lauds Supreme Court Decision to Protect Health Benefits for Retired Public Employees

CalPERS applauds a recent California Supreme court ruling which found that health benefits for government retirees may not be eliminated if state and local governments clearly promised those benefits as part of employment agreements.

In a closely-followed Orange County case, the court unanimously ruled when health care benefits have been approved for retirees, a lifetime right to those benefits can be implied. Health benefits can be considered a vested right, fully protected by both contract law and the constitution if it can be proven that health benefits were promised to workers.

"Under California law, a vested right to health benefits for retired county employees can be implied under certain circumstances from a county ordinance or resolution," Justice Marvin R. Baxter wrote for the court.

CalPERS provides health benefits to more than 1.3 million public employees, retirees, and their families.

Gloria, In accordance with PEMHCA section 22892, the city cannot change the minimum amount CalPERS requires for contributions. However, the city can change any contributions over the minimum amount. We suggest negotiating with the city regarding reinstating the additional contribution amount.

After saying I would have medical insurance provided by the City of Monterey Park, they froze the part they pay because the Union gave it up for a 2% raise for the still in service employees. I would like to know what steps should be taken in order to get the medical insurance fully paid by the City.

Please try to call in on an abscure language line ie vietnamese operators are bilingual may balk but talk anyway. Good luck. I have also tried not to participate in the phone tree sometimes it works.

I agree with Pamlyn. I, too, am having problems (although not nearly as bad as hers). I was told I would receive a Medicare reimbursement for myself and my husband. My husband was granted ONE reimbursement, and I have not received any reimbursement since the day I qualified for Medicare Part B. I have 1) called CalPERS; 2) visited my local office; and 3) e-mailed CalPERS (three times). They just ignore me. There is NO OPTION to get to talk to the people responsible for the oversight. Next, I plan to fly to Sacramento and stay there until SOMEONE takes care of my issue.

PERS has one phone number for everyone to call in on, no matter who you are. The wait time can be up to 4 hours. This is a problem because PERS screwed up and cut my retirement benefits off and pulled money out of both my savings and checking account the night before Thanksgiving. I got a letter from PERS 3 days later giving me condolences on my own death. They also asked for more money from me. They then deposited and took back my December check as well. In addition to that ( being dead and broke isn't enough ) they cut off my medical insurance. I did get through to PERS once and the man who spoke to me said..."Oh man, We really screwed up." He couldn't tell me when they were going to fix it. So before you start thinking about doing new pension stuff- why don't you fix what you did to me. I am not dead- I was charged overdraft fees and all my monthly bills are paid automatically. That should be fun. You need to fix this PERS!
